Midrising Terms of Service

Overview

In these terms, "we", "us" and "our" mean Midrising, and "you" means anyone who visits our site or buys from us.

These terms cover midrising.com.au, our online store, and the digital guides, templates and other products we sell through it (the "Services"). By using the Services or placing an order, you agree to these terms, our Privacy Policy and our Refund Policy. If you don't agree, please don't use the Services.

Using the site and your account

You must be at least 18 to buy from us. The information you give us at checkout, or when you create an account, must be accurate and complete.

You're responsible for keeping any login or password we give you private, and for everything done with it.

Our products and how you receive them

Everything we sell is digital, and nothing is posted to you. Depending on the product, you'll receive a downloadable file (such as a PDF or Excel template) or personal access to an interactive guide on a password-protected site hosted at read.midrising.com.au.

We describe our products as accurately as we can, but screens and software differ, so a product may look slightly different on your device. We may update or improve a product, and we may stop selling one at any time. If we plan to remove a guide you've already bought, we'll give you reasonable notice.

Orders, prices and payment

Prices are in Australian dollars (AUD). The price you pay is the price shown when you place your order, and it appears on your order confirmation email.

When you place an order, you're making an offer to buy. We accept it when we send your confirmation. We can decline or cancel an order, for example if a price or product detail was listed in error, and if we do we'll refund anything you've paid.

Payments are processed securely through Shopify and its payment providers. We don't see or store your full card details. You confirm that you're authorised to use the payment method you choose.

Refunds and your consumer rights

Our Refund Policy explains when and how you can get a refund, and it forms part of these terms.

Our products come with guarantees that can't be excluded under the Australian Consumer Law. For example, you're entitled to a replacement or refund for a major failure, and to compensation for other reasonably foreseeable loss or damage. Nothing in these terms limits those rights.

Your licence and our intellectual property

Everything on the Services, including our guides, templates, text, images, logos, podcast content and the Midrising name, is owned by us or our licensors and is protected by copyright and other laws.

When you buy a product, we give you a personal, non-exclusive, non-transferable licence to use it for yourself. You can save or print a copy for your own use. You can't share your login, password or access link, share the files with others, resell, copy, publish or republish any product or part of it, or use it to create or sell something similar.

Midrising and our logos and product names are our trademarks. Please don't use them without our written permission.

Information, not advice

Our guides, podcast, articles and templates are general information and prompts for reflection. They are not medical, psychological, legal, financial, building or other professional advice, and they don't replace it.

Our project templates, such as the renovation, pool build and wedding planners, are planning tools. Rules, costs and approvals vary by location, so check requirements with your local council, a qualified professional or your suppliers before you rely on them.

If you're finding things hard, please talk to your doctor or another qualified health professional. If you need urgent support in Australia, call Lifeline on 13 11 14. In an emergency, call 000.

Feedback and submissions

If you send us a review, comment, idea or other content, you give us a non-exclusive, royalty-free, worldwide licence to use, edit and publish it in any medium to run and promote Midrising. We won't publish your name with a submission without your permission.  Answers you enter in an interactive guide are different: they are saved anonymously, handled as described in our Privacy Policy, and never published individually.

You confirm that what you send is yours to share and doesn't break the law or anyone's rights. We can remove anything we think is unlawful, offensive or inappropriate, but we're not obliged to monitor submissions.

Third-party services and links

Some of our Services rely on third-party platforms, such as Shopify for our store and checkout, Canva for our interactive guides, and Tally for the forms and polls inside them. Our site may also link to other websites, tools and podcast platforms. We don't control them and aren't responsible for their content, availability or policies, so please read their terms before you use them.

Prohibited uses and automated access

Please use the Services for lawful purposes only. You must not:

• break any law or infringe anyone's rights
• upload viruses or malicious code, or interfere with the security or operation of the site
• harass, abuse or impersonate anyone
• send spam or promotional material through the Services
• try to get around any login, password or access control
• copy, scrape or republish the content of a protected guide, or share access to it

Search engines and AI answer engines are welcome to read and cite our public pages. Automated tools and software agents must not access protected guides, accounts or checkout without our permission, must not disguise themselves as human, and must not bypass CAPTCHAs or the other measures we use to control access.

Our relationship with Shopify

Midrising is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Midrising. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Midrising, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Midrising.

Privacy

How we collect and use your personal information is explained in our Privacy Policy. Because our store is hosted by Shopify, Shopify also collects and processes some information about how you use the Services, and some information may be handled by providers outside Australia. By using the Services, you acknowledge that you've read the Privacy Policy.

Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.

Subject to that, and to the extent the law allows: we provide the Services as general information and don't promise they will be uninterrupted or error-free; we aren't liable for indirect or consequential loss, including lost profits or lost data; and where we're allowed to limit our liability for a breach of a consumer guarantee, we limit it to resupplying the product or paying the cost of resupplying it.

You agree to cover the loss we suffer because you breach these terms or misuse the Services, for example by sharing paid content.

Ending access

We can suspend or end your access to the Services, or to a purchased guide, if you breach these terms, for example by sharing your login or republishing our content. You can stop using the Services at any time. The parts of these terms that by their nature should continue after access ends, including the licence limits, liability and governing law, will keep applying.

Errors, changes and governing law

If we find an error in a price, description or other information, we may correct it, and cancel and refund an affected order.

We may update these terms by posting the new version on this page. If we make material changes, we'll tell you as the law requires. By continuing to use the Services after an update, you accept the updated terms.

These terms are governed by the laws of New South Wales, Australia, and you and Midrising submit to the non-exclusive jurisdiction of the courts of New South Wales. If any part of these terms is found to be unenforceable, the rest still applies. These terms, together with our Privacy Policy and Refund Policy, are the whole agreement between you and us.
